Terms of Service

1. Acceptance of Terms

By creating an account or using the RecruitMS applicant tracking system (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

RecruitMS provides a web-based applicant tracking system designed to help small businesses and recruiting teams post jobs, collect and organize applicants, parse resumes, and manage the hiring process. The Service is provided on a subscription basis with a free tier and paid plans.

3. Account Registration

To use the Service you must register for an account. You agree to:

• Provide accurate and complete information during registration
• Keep your login credentials confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

You must be at least 18 years old and have the legal authority to enter into these Terms to create an account.

4. Free Plan and Paid Subscriptions

RecruitMS offers a free plan that includes 1 active job listing and up to 25 applicants per job, with no expiration date and no credit card required. Paid plans unlock additional jobs, applicants, and features.

Paid subscriptions are billed monthly. You may upgrade, downgrade, or cancel at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months.

5. Acceptable Use

You agree not to use the Service to:

• Post jobs or collect applicant data for illegal purposes
• Discriminate against candidates based on protected characteristics
• Upload malware, spam, or any content that interferes with the Service
• Attempt to gain unauthorized access to any part of the Service or infrastructure
• Resell or sublicense access to the Service without written permission
• Scrape or extract data from the Service using automated means

6. Your Data

You retain ownership of all data you upload or create in the Service, including job listings, applicant records, and company information. By using the Service you grant RecruitMS a limited license to store and process your data solely for the purpose of providing the Service to you.

Each account operates in an isolated workspace. Your data is never visible to or shared with other organizations using the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information.

8. Intellectual Property

The RecruitMS name, logo, software, and all related content are owned by RecruitMS and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology beyond what is necessary to use the Service.

9. Service Availability

We make reasonable efforts to keep the Service available but do not guarantee uninterrupted access. We may perform maintenance, apply updates, or temporarily suspend the Service with or without notice. We are not liable for any losses resulting from downtime.

10. Termination

You may close your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or remain inactive for an extended period. Upon termination, your data may be deleted after a reasonable retention period.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or continuously available.

12. Limitation of Liability

To the fullest extent permitted by law, RecruitMS and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service will not exceed the amount you paid to RecruitMS in the three months prior to the claim.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service will be resolved in the applicable jurisdiction.
